Solicitor pays Elvis fan for negligence
A 42-year-old woman from Dagenham has held her negligent personal injury solicitor to account ensuring her a payout of £2,000.
The professional negligence compensation settlement stems from a claim the woman made for facial and hip injuries she sustained when tripping over a sleeping air steward. She was returning from a birthday trip to the home of Elvis Presley in Graceland, Memphis, Tennessee. on the return leg from birthday trip to the home of Elvis Presley, Graceland, Memphis, Tennessee.
However, it eventually became clear that she had left mattersthings in the hands of a negligent personal injury solicitor; he failed to file the claim within the two-year time limit, forgetting that the time limit for claims for accidents in the air is one year shorter than for most other kinds of holiday accident.
It is reported that the trip represented a “‘dream come true”‘ for the mother-of-one. However, as she said, “‘A few hours before we landed I got up to go to the toilet. I was walking down the aisle when I fell face first over the steward. I think in business class they have sleeping compartments but he was lying right across the aisle. I just wasn’t expecting him to be there – who would be?”‘
The woman suffered a number of injuries, including a broken nose, torn ligaments and muscular injuries; she was left reliant on the use of a mobility scooter for six weeks.
Because the woman’s London-based personal injury solicitors failed to submit her claim in time, she was left with little choice but to proceed with a claim for professional negligence.
However, the solicitor conceded liability and agreed to a payout. “‘She’s a nice lady and I made an error as a lawyer, which I wouldn’t usually do,’ he said. ‘It was because of the two-year limitation period, so I said we’re happy to pay up for this.”‘
