Five Figure Compensation Secured in Undiagnosed Cancer Case

Healys Solicitors’ specialised medical negligence team has helped the husband of a 50 year old woman claim compensation after the hospital failed to diagnose her cancer.

In November 2008 Mrs V attended hospital complaining of pain in her abdomen.  She was discharged from the hospital and asked to seek a GP advice if the symptoms worsened. Unfortunately Mrs V died of thyroid cancer a few months later.

The outcome of the case

Mr V decided to contact Healys Solicitors’ specialised medical negligence team and one of our experienced partners, Jonathan Austen-Jones, was able to deal with the claim. Jonathan argued that the chance for a liver biopsy was missed during her visit to hospital and although this would not affect the unfortunate outcome, palliative care could have been arranged to ease Mrs V’s suffering.

Jonathan was able to secure Mrs V’s husband a five figure sum in compensation.

Jonathan Austen-Jones, medical negligence specialist, commented “Even though the unfortunate outcome could not have been prevented,  the hospital had a duty to provide Mrs L with the best possible care.  They did not and unfortunately Mrs L and her family suffered greatly during her last few months.”
