Case Study: Professional Negligence Claim against Law Firm
Robert Johnson, Partner and Head of Professional Negligence at Healys LLP, successfully represented a claimant win a professional negligence claim against a firm of solicitors.
The case initially arose from the manner in which the firm in question had dealt with their then client’s claims in an Employment Tribunal for unfair dismissal, wrongful dismissal, under the Public Interest Disclosure Act 1998 and unlawful sexual discrimination.
In particular, the matter concerned the advice/lack of advice given by the solicitors on :-
- Limitation in failing to advise the client properly or at all on the strict timetable for taking certain steps in the Employment Tribunal causing thereby significant delay and loss;
- Loss of opportunity in failing to deal properly with the employment claims causing the client to recover significantly less/nothing for such claims which had both merit and value; and
- Interaction with another claim (now successfully pursued) against the client’s former employer for some (but not all) of the employment claims that we were able to preserve/prosecute.
The claimant’s case was successfully settled for a significant amount and without the need to issue legal proceedings and thereby avoiding the significant cost, delay and stress that invariably are the consequences of litigation.
After the settlement the claimant said:

I have been assisting my brother who has been too ill to work since 2016. In 2017 the DWP refused his Employment Support Allowance (contribution based) because he was short of NIC In the tax year 2014/15. We have been to the Tax Tribunal and DWP Complaints to ICE , Tax Tribunal and even the Parliamentary Ombundsman, to no avail. During t(e Tax Tribunal my brothers former employer South West Ambulance NHS Trust confirmed they had underpaid his rolled up holiday pay in 2014-2016. The HMRC Litigator sent a letter confirming this dated 2nd September 2020. The letter says that it was likely the underpayment would have allowed my brother Martin to have achieved enough NIC in 2014/15 to have been paid his ESA. His MP referred him to a legal advice centre in Torquay where he lives and their advice was that given the HMRC letter they believe that he should seek a case a Professional Negligence case against the Trusts Payroll department (a third party entity). I have calculated the loss of ESA Since 3/11/2017 is £35-36.000. Additionally the recent Supreme Court decision in The Harper Trust v Brazel also assists him as he was a zero hours worker and they were paying rolled up holiday pay (added annual leave pay into his hourly rate, which was unlawful under EU a law) as any shortfall will have been lost due to his having to be paid his holiday pay up front.
