For personal injury claims, proceedings should be commenced within three years of the date of the accident. This is known as the limitation period. In some circumstances the limitation period starts from the date the injury is identified, that is to say the date of knowledge rather than the date the accident occurred; for example in claims for work-related disease.
For the claimants under the age of 18, limitation runs from their 18th birthday; and for claimants in certain cases the courts have a discretion to waive the limitation period.
Aviation claims and claims under the Criminal Injury Compensation Scheme must be made within two years.
