Probate is the general term used when dealing with the estate of a deceased person who has left a valid will. A grant of probate is the official document (incorporating a copy of the last will) which gives the executor of that will, legal authority to administer with the deceased’s estate. Alternatively, where the deceased has not left a valid will, letters of administration may be required to be obtained by the deceased’s personal representatives to enable them to collect and distribute the deceased’s assets to the persons entitled to receive them under the Rules of Intestacy (dying without a valid will).
